EarthShare, Inc. (“EarthShare,” “we,” “us,” or “our”) respects the privacy of our donors, workplace giving participants, corporate partners, nonprofit partners, fiscal sponsorship participants, and visitors to our websites and platforms.
This Privacy Policy explains how EarthShare collects, uses, shares, retains, and protects information in connection with our donor-advised fund (“DAF”) programs, workplace and corporate giving services, fiscal sponsorship services, websites, applications, and related offerings (collectively, the “Services”).
This Privacy Policy should be read together with EarthShare’s applicable Donor-Advised Fund Terms, Workplace & Corporate Giving Services Terms, and other program-specific agreements.
By using the Services, creating an account, participating in a program, submitting information to us, or otherwise interacting with EarthShare, you acknowledge the practices described in this Privacy Policy.
1. Scope and Relationship Types
EarthShare provides Services to a variety of users and organizations, including:
- Individual donors and DAF account holders
- Employees participating in workplace giving programs
- Corporate sponsors and corporate giving administrators
- Fiscal sponsorship participants and sponsored projects
- Nonprofit organizations receiving grants or donations
- Visitors to EarthShare websites and applications
Depending on the nature of your relationship with EarthShare, different information-sharing practices, reporting structures, and account administration features may apply.
For example:
- Workplace giving accounts may involve information provided by an employer, payroll provider, benefits platform, or corporate sponsor
- Corporate giving programs may permit designated company administrators to access program-level reporting and participation metrics
- DAF accounts may involve grant recommendation history, contribution records, tax documentation, and compliance-related information
- Fiscal sponsorship programs may involve project-level financial reporting and administrative oversight.
2. Information We Collect
Information You Provide Directly
We may collect information you provide when you:
- Create or manage an EarthShare account
- Open or contribute to a DAF account
- Participate in workplace or corporate giving programs
- Recommend grants or make charitable contributions
- Apply for fiscal sponsorship or participate in sponsored projects
- Communicate with EarthShare
- Subscribe to updates or marketing communications
- Submit forms, applications, surveys, or support requests

4. Workplace Giving and Corporate Program Information
If you participate in a workplace giving, employer-sponsored, or corporate charitable program administered through EarthShare, we may share limited information with your employer, corporate sponsor, or program administrator as necessary to operate the program.
Depending on the structure of the program, this may include:
- Participation status
- Contribution activity
- Matching eligibility
- Campaign engagement metrics
- Aggregate or program-level reporting
- Grant fulfillment status
- Administrative reporting necessary to operate the program
EarthShare does not disclose personal DAF account information, unrelated grant recommendations, or unrelated charitable activity to employers or corporate sponsors except:
- As necessary to administer the applicable program
- To comply with law or regulatory obligations
- To fulfill program requirements
- With user authorization or direction
Participation in employer-sponsored giving, workplace giving, or corporate philanthropy programs may also be subject to separate program agreements, including the EarthShare Workplace & Corporate Giving Services Terms.
5. Grantmaking and Recipient Disclosures
EarthShare may share donor information with recipient charitable organizations in connection with grant distributions.
Depending on donor preferences and applicable program settings, shared information may include:
- Donor name
- Mailing address
- Email address
- Grant amount
- Grant purpose or designation
- Related communications
Donors may elect to recommend grants anonymously where permitted.
Anonymous grant recommendations affect what information is shared with recipient organizations but do not eliminate EarthShare’s internal recordkeeping, compliance, tax, audit, or regulatory obligations.
6. Compliance, Verification, and Security Activities
EarthShare may use information to:
- Verify identity
- Conduct fraud prevention and risk monitoring
- Perform sanctions and prohibited-party screening
- Comply with anti-money laundering obligations
- Investigate suspicious or prohibited activity
- Maintain platform integrity and security
- Enforce agreements and policies

EarthShare may work with financial institutions, payment processors, compliance providers, and security vendors to support these activities.
7. Service Providers and Third Parties
EarthShare works with third-party vendors and service providers that perform services on our behalf, including:

Certain payment processing and financial transaction functions are performed by trusted third-party providers, including Stripe and ChariotPay.
EarthShare does not store full payment card information within its systems.
Payment processors and financial service providers may independently collect and process information necessary to complete transactions and comply with financial regulations. Their use of information is governed by their own privacy policies and legal obligations.

EarthShare maintains administrative, technical, and organizational safeguards designed to protect personal information and transaction data.
These safeguards include:

No method of electronic transmission or storage is completely secure. Accordingly, EarthShare cannot guarantee absolute security.

Certain contribution, transaction, grant, compliance, and financial records may be retained even after an account is closed or deletion is requested where retention is required or permitted by applicable law.

EarthShare primarily operates in the United States. Information may be processed, stored, or transferred within the United States or other jurisdictions where EarthShare or its service providers operate.
By using the Services, you acknowledge that information may be transferred to and processed in jurisdictions with different data protection laws than those of your country or state of residence.
14. Children’s Privacy
The Services are not directed to children under the age of 13, and EarthShare does not knowingly collect personal information from children under 13.
If EarthShare becomes aware that personal information has been collected from a child under 13 without appropriate consent, we will take reasonable steps to delete such information.
15. Changes to This Privacy Policy
EarthShare may update this Privacy Policy from time to time to reflect operational, legal, regulatory, or platform changes.
If we make material changes, we may provide notice through the Services, by email, or by updating the effective date above.
Continued use of the Services after updates become effective constitutes acceptance of the revised Privacy Policy.
16. State Law Disclosures
Certain states require charitable organizations, fundraising platforms, donor-advised fund sponsors, or charitable solicitation operators to provide specific disclosures regarding registration, charitable status, or donor rights.
EarthShare may provide additional state-specific disclosures, notices, or registration information where required by applicable law.
Residents of certain states may also have additional privacy rights under applicable state privacy laws, including rights relating to access, correction, deletion, or limitation of certain personal information processing activities.
California Privacy Rights
California residents may have additional rights under the California Consumer Privacy Act (“CCPA”) and related California privacy laws, subject to applicable exemptions and limitations.
These rights may include the right to:
- Request access to certain categories or specific pieces of personal information
- Request correction of inaccurate personal information
- Request deletion of certain personal information
- Request information regarding categories of information disclosed for business purposes
- Limit certain uses of sensitive personal information where applicable
EarthShare does not sell personal information or share personal information for cross-context behavioral advertising purposes as defined under California law.
Colorado, Connecticut, Virginia, and Other State Privacy Rights
Residents of Colorado, Connecticut, Virginia, Utah, and other states with applicable privacy laws may have additional rights regarding their personal information, subject to statutory exemptions and limitations.
EarthShare will process verified requests in accordance with applicable law.
Nevada Residents
Nevada residents may request that EarthShare not sell certain covered information under Nevada law. EarthShare does not currently sell covered information as defined by Nevada law.

17. Supplemental Notes Regarding Workplace and Corporate Programs
For workplace giving and corporate-sponsored charitable programs, employers, benefits platforms, payroll providers, or corporate sponsors may independently collect, process, or retain information subject to their own privacy policies and legal obligations.
EarthShare is not responsible for the privacy or data handling practices of third-party employers, payroll providers, benefits administrators, or external platforms.
Users participating in employer-sponsored programs should review applicable employer or program privacy notices in addition to this Privacy Policy.
